1. Agreement to Terms

By accessing and using Duly ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. These Terms and Conditions govern your use of the Service provided by Duly.

The Service provides device protection plans and repair services exclusively for students at participating educational institutions.

2. Eligibility

To use our services, you must:

  • Be currently enrolled as a student at a recognized educational institution
  • Provide valid student identification when requested
  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts

We reserve the right to verify student status and may suspend services if eligibility cannot be confirmed.

3. Membership Plans

3.1 Plan Options

We offer the following membership tiers:

  • Basic: Coverage for one device up to ZMW500
  • Standard: Coverage for up to three devices up to ZMW1,500
  • Premium: Unlimited devices with priority support

3.2 Student Discount

All eligible students receive a 20% discount on repair costs. This discount applies only to labor and parts for covered repairs and cannot be combined with other promotions.

3.3 Payment Terms

Membership fees are billed annually. Payments are non-refundable except as required by law. Failed payments may result in service suspension.

4. Device Coverage

4.1 Eligible Devices

We cover the following device categories:

  • Laptops and notebooks
  • Smartphones and mobile devices
  • Tablets and e-readers
  • Smartwatches and wearables
  • Headphones and audio devices
  • Digital cameras

4.2 Device Registration

You must register each device with accurate information including serial numbers, purchase dates, and device condition. Coverage begins only after successful registration.

4.3 Coverage Limitations

Coverage is subject to the following limitations:

  • Devices must be less than 3 years old at time of registration
  • Pre-existing damage is not covered
  • Cosmetic damage that doesn't affect functionality
  • Loss or theft of devices
  • Intentional damage or misuse

5. Claims Process

5.1 Filing a Claim

To file a claim, you must:

  • Submit a claim through our online portal
  • Provide detailed description of the issue
  • Include photos of the damage when applicable
  • Cooperate with our assessment process

5.2 Claim Approval

We reserve the right to approve or deny claims based on:

  • Coverage verification
  • Cause of damage assessment
  • Device eligibility
  • Membership status

5.3 Repair Process

Approved claims will be processed through our network of certified repair partners. Repair timelines may vary based on part availability and repair complexity.

6. User Responsibilities

As a user, you agree to:

  • Provide accurate and current information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized account access
  • Use the Service only for lawful purposes
  • Comply with all applicable laws and regulations

7. Privacy and Data Protection

Your privacy is important to us. Please refer to our Privacy Policy for detailed information about how we collect, use, and protect your personal data.

We implement reasonable security measures to protect your information but cannot guarantee absolute security.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Duly and are protected by international copyright, trademark, and other intellectual property laws.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe:

  • Violates these Terms and Conditions
  • Involves fraudulent or abusive behavior
  • Poses a security risk to our Service
  • Could subject us to liability

10. Limitation of Liability

To the maximum extent permitted by law, Duly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our total cumulative liability to you for all claims shall not exceed the total amount of fees paid by you to us in the six months preceding the claim.

11. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Duly disclaims all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Duly is established, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
